Affiliate Program Operating Agreement

Any person or entity participating in our affiliate marketing program must accept and adhere to this Affiliate Program Operating Agreement without making any changes or modifications to it. By registering for or using the Affiliate Site, you agree to this Agreement, including the Program Policies.

You represent, warrant and agree to:

(a) Participate in the Affiliate Program and create, maintain and operate your Site in accordance with the provisions of this Agreement;

(b) That neither your participation in the Affiliate Program, nor the creation, maintenance, or operation of your Site will violate any applicable laws, rules, ordinances, regulations, orders, licenses, permits, guidelines, codes of conduct, industry standards, self-regulatory standards, judgments or decisions, or any other requirements of a governmental authority having jurisdiction over you (including all communications regulatory rules, data protection, advertising and marketing);

(c) That you are entitled and have the legal capacity to enter into contracts (for example, that you are not a minor or disqualified from contracting);

(d) That you have independently evaluated the appropriateness of participating in the Affiliate Program and are not relying on or relying on any representations, warranties or representations other than those expressly set forth in this Agreement.

Compliance requirements:

The agreement may be terminated at any time at the wish of any of the parties, without any cause, without prejudice to any possible settlements that may be pending.

In the event that you violate this Agreement, or the terms and conditions of any other marketing agreement for Vives de la Cortada we reserve the right, in addition to any other rights and remedies available to us, to stop payment in perpetuity and to the extent permitted by law (and you acknowledge that you will not be entitled to receive) commission income that, otherwise, they would have been yours under this Agreement, whether or not they are directly related to such infringement, all without notice and without prejudice to your rights to Vives de la Cortada to claim damages in excess of that amount.

The Services will not be misrepresented in any way, including their prices, plans, discounts or features.

They will not offer or provide warranties, incentives, rewards or compensation, except as set forth in the vivenscortadaimport Terms of Service.as Vives de la Cortada SCP has approved in writing;

It is strictly forbidden any type of publications or advertising that may damage the image of Vives de la Cortada SCP as violent, pornographic, illicit content or that promote violence, discrimination, intolerance, racism, hatred, harassment or harm against any individual or group.

No illegal or spamming methods of promotion shall be used ;

No iframe tags or any other technique or technology will be used to add the Affiliate tracking cookie to a referral by any means other than the actual click.

It is forbidden to use link masking or concealment techniques or technology for the purpose of promoting Vives de la Cortada on websites and / or networks that they do not explicitly mention in their accounts.

You will not place links to Vives de la Cortada or any other reference to Vives de la Cortada on coupon websites;

It is forbidden to self-refer in any way. This includes reference to any operation or website in which affiliates have control, ownership or an equity interest. Any reference in which payment is made by a controlled payment method or belonging to the Affiliate shall be deemed to be in violation of these Terms.

Our customers are not and do not become, your customers, by virtue of their participation in the Affiliate Program. Accordingly, as with you and us, all prices, conditions of sale, rules, policies and operating procedures relating to customer orders, customer service and product sales collected on the Vives de la Cortada Site shall also apply to such customers and may be modified at any time. You may not deal directly with, or address to, or manage any contact received from, any of our customers; and, if any of our customers contact you for a matter relating to interaction with Vives de la Cortada, you must indicate that customers are obliged to follow the contact instructions contained on said vivescortadaimport.com Site to address customer service issues.

Commissions and payments:

1. We make no warranties or commitments regarding the volume of traffic or the amount of commission revenue that you may expect, at any time, by reason of your participation in the Affiliate Program; and, in no event, will we assume any responsibility for any actions or actions you take or may take based on your own expectations.

2. Commissions are paid by PayPal, or any other payment method selected by Vives de la Cortada. Vives de la Cortada will not be liable for any transaction fees charged by PayPal or any other payment provider.

3. Commissions will be paid only when the balance of all commissions due exceeds € 50.00

4. Vives de la Cortada shall not be liable for lost, stolen or incorrectly directed commission payments.

Commissions will only be paid to one affiliate for each referred client. If there is a dispute over which Affiliate should receive the Commission, Vives de la Cortada will determine, at its own discretion, which Affiliate should receive the Commission, and the decision to Vives de la Cortada in this matter will be final.

You are solely responsible for all tax obligations owed to tax authorities arising in connection with your participation in our Program. Vives de la Cortada will not withhold any taxes of any kind from its Commissions.

Legislation:

Affiliates will comply with all applicable local, state, national and international laws and regulations, including but not limited to consumer protection, advertising, anti-bribery, export control and data protection laws.

Affiliates will only refer potential customers to Vives de la Cortada who (a) have provided valid contact information, (b) are not bots, counterfeit, illegitimate or otherwise fraudulent , and (c) meet the requirements set forth in the Vives de la Cortada Terms of Service.

Vives de la Cortada will not be responsible for tracking cookies that have been intentionally or accidentally deleted. No commission will be paid for tracking errors of any kind, including but not limited to tracking errors caused by the affiliate's editing, concealment or alteration of the Affiliate Link.

We reserve the right to modify any of the terms and conditions contained in this Agreement, at any time and in our sole discretion, by posting on the Affiliate Site a notice of change, a revised Agreement or a revised Program Policy, or by sending you notice of such modification by mail.
